1. Acceptance of Terms

By accessing or using the Medpaw application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Medpaw. We may modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the App following any changes indicates your acceptance of the new Terms.

2. Description of Service

Medpaw is a pet medication management application designed to help users:

  • Track medications and supplements for their pets
  • Receive reminders for medication administration
  • Log symptoms and health observations
  • Store pet health documents and records
  • Share pet care responsibilities with family members

Always seek the advice of your veterinarian or other qualified animal health provider with any questions regarding your pet's health.

3. User Accounts

3.1 Account Creation

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password confidential and secure
  • Notify us immediately of any unauthorized use of your account

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree not to share your account credentials with others. We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

4.1 Your Content

You retain ownership of any content you submit to the App, including pet information, photos, documents, and notes ("User Content").

4.2 License Grant

By submitting User Content, you grant Medpaw a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing and improving the service. We will not sell your content or use it for advertising purposes.

4.3 Content Standards

You agree that your User Content will not:

  • Violate any applicable laws or regulations
  • Infringe on any third party's intellectual property rights
  • Contain malicious code, viruses, or harmful content
  • Be fraudulent, false, or misleading

5. Prohibited Uses

You agree not to:

  • Use the App for any unlawful purpose or in violation of any laws
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the proper functioning of the App
  • Upload malicious code, viruses, or harmful content
  • Use automated systems to access the App without permission
  • Impersonate any person or entity
  • Collect or harvest user information without consent
  • Use the App for any commercial purpose without our authorization

6. Medical Disclaimer

THE APP DOES NOT PROVIDE VETERINARY ADVICE.

The content provided through the App, including medication reminders, health tracking features, and any educational information, is for informational purposes only. It is not intended to be a substitute for professional veterinary advice, diagnosis, or treatment.

  • Always consult a qualified veterinarian for your pet's health concerns
  • Never disregard professional veterinary advice because of information in the App
  • In case of a medical emergency, contact your veterinarian or emergency animal hospital immediately

Medpaw is not responsible for any decisions made based on information provided by the App. You assume full responsibility for your pet's care and treatment decisions.

7. Subscriptions and Payments

7.1 Free and Paid Features

Some features of the App are available for free, while others require a paid subscription ("Pro Plan"). Current subscription options and pricing are displayed within the App.

7.2 Billing

Subscriptions are billed through the Apple App Store. By purchasing a subscription, you agree to their terms of service and payment policies.

7.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your device's app store settings.

7.4 Refunds

Refunds are handled according to the policies of the Apple App Store. Please contact them directly for refund requests.

8. Intellectual Property

The App and its original content (excluding User Content), features, and functionality are owned by Medpaw and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our App or its content without our written permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied
  • We do not warrant that the App will be uninterrupted, error-free, or secure
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
  • Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim

10. Indemnification

You agree to indemnify and hold harmless Medpaw and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third party rights
  • Your User Content

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the App will immediately cease
  • We may delete your account and User Content
  • All provisions of these Terms which should survive termination shall survive

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Medpaw operates, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by:

  • Posting the new Terms in the App
  • Updating the "Last Updated" date
  • Sending an email notification for significant changes

Your continued use of the App after changes constitutes acceptance of the new Terms.
